Chapter I General Rules

Article 1 (Purpose)
The purpose of this Agreement is to prescribe basic matters concerning the terms and procedures of use of the services provided by <BEST eSIM KOREA> (hereinafter referred to as the “Site”).

Article 2 (Effect of Terms and Conditions and Changes)
① These terms and conditions are effective by notifying the customer through the service screen or other means.
② The Site may change the contents of these Terms and Conditions, and the changed Terms and Conditions shall become effective by announcing or notifying in the same manner as in paragraph 1.

Article 3 (Definition of Terms)
The terms used in these Terms and Conditions are defined as follows.
① Customer: It refers to a user who enters into a service use contract with a site or makes a purchase for service use.
② Reservation: This refers to the reservation of Data + Calls & SMS eSIM products provided by the site for customers to rent at the designated pickup location.
③ Pick-up reservation number: It refers to the number given when you purchase a product (Data + Calls & SMS eSIM) that requires pick-up and when the reservation is completed. This is the number used to pick up items purchased at the designated.
④ QR code: It refers to the code given through the site so that customers can purchase and use eSIM products.
⑤ Activation code: It refers to the manual input code given through the site so that customers can purchase and use eSIM products.

Chapter 2 Service Use Agreement

Article 4 (Establishment of a Use Contract)
① When purchasing a product, you agree to these terms and conditions by pressing the Accept Terms and Conditions button.
② The use contract is established by the site accepting the application for use after agreeing to the terms and conditions of use of the service.

Article 5 (Application for Purchase and Reservation)
① In order for the applicant to use this service, he/she must record and submit the user information required by the site’s prescribed purchase and reservation application form.
② All user information on the rental and reservation application forms is considered to be real data. Users who do not enter their real names or physical information are not legally protected and may be subject to service restrictions.

Article 6 (Acceptance of application for Purchase and Reservation)
① The site accepts the customer’s application for service use with the exception of paragraphs 2 and 3.
② The site may withhold consent until the reasons for restriction on consent to the application are resolved in the following cases.
A. Where there is no room for inventory of service-related products
B. In case of technical difficulties
C. If other sites are deemed necessary
③ The site may refuse consent if the applicant :
A. Where an application is made using the name of another individual
B. In the case of applying by falsely stating user information
C. Where an application is filed for the purpose of hindering the social well-being order or good customs
D. Where the requirements for application for use prescribed on other sites are not satisfied

Article 7 (Change of Customer Information)
If the customer information listed at the time of application is changed, the customer must request an email or call customer center to correct it, and the customer is responsible for all problems caused by not changing it.

Chapter 3 Duties of Contracting Parties

Article 8 (Duty of Site)
① The site provides customers with the following services.
A. eSIM purchase and reservation services
② The Site shall not divulge, disclose or distribute the personal information of the Customer acquired in connection with the provision of rental and booking services to others without the Customer’s consent, nor shall it be used for commercial purposes other than service-related business. However, exceptions are made in cases falling under any of the following subparagraphs.
A. Where a request is made by a state agency pursuant to the provisions of the Act on the Framework Act on Telecommunications, etc
B. Where there is an investigative purpose for a crime or at the request of the Information and Communication Ethics Committee
C. Where there is a request according to the procedures prescribed by other relevant laws and regulations
③ The Site is obligated to provide services continuously and reliably as set forth in these Terms and Conditions.

Article 9 (Customer’s Duty)
① The customer shall not perform any of the following actions when using the service.
A. Application for purchase and reservation with personal information of someone other than you
B. Unauthorized use of other customers’ emails and order numbers
C. Reproducing information obtained from the service for purposes other than the use of the customer without prior approval of the site, using it for modification, publication, broadcasting, etc., or providing it to others
D. Illegal use of received products after leasing and reservation
E. Infringement of other rights, such as copyright on the site, copyright of another person, etc
F. The act of disseminating information, sentences, figures, etc. that violates public order and customs
G. An act that is objectively judged to be associated with a crime
H. Other acts in violation of relevant laws and regulations
② The customer shall comply with the relevant laws and regulations, the matters prescribed in these terms and conditions, the service usage guidance, and precautions.
③ Customers must comply with the usage restrictions that the site has posted or separately announced in the Service Notice for each content.

Chapter 4 Provision and Use of Services

Article 10 (Customer’s obligation to manage order number, pickup reservation number, QR code, activation code)
① Customer is responsible for all management of order number, pickup reservation number, QR code, and activation code. The customer is fully responsible for all results caused by the unauthorized use of the order number, pickup reservation number, QR code, and activation code assigned to the customer.
② Customers must notify the site of any improper use of order numbers, pickup reservation numbers, QR codes, activation codes, or other security violations.

Article 11 (Restriction and Suspension of Services)
① The site may restrict or suspend all or part of its services in the event of exhibition, catastrophe, natural disaster, or possible national emergency, or other compelling reasons such as termination of telecommunications services by key operators under the Telecommunications Business Act.
② When the site restricts or suspends the use of services pursuant to paragraph (1), it shall notify the customer of the reasons, the period of restriction, etc. without delay.

Chapter 5 Rental and Reservation Cancellation and Refund

Article 12 (Change of Information)
If a customer wants to change the information such as the name, passport number, pick-up place, and pick-up date entered during rental and reservation, they can change it using the customer center on the website.

Article 13 (Purchase and Reservation Cancellation)
Customers may cancel the service purchase and reservation, and if they cancel, they must apply for the purchase and reservation cancellation through the website or by customer center or e-mail. The site will restrict the customer’s use of the service from the time of application for purchase and cancellation is received. The site will be immediately purchased and canceled if the customer wishes to buy and cancel the reservation under any of the following subparagraphs:
① If the customer uses the service product illegally
② Where the Information and Communication Ethics Committee requests cancellation of the purchase
③ Where a customer fails to respond to a statement of opinion without justifiable grounds
④ Where an application for purchase has been made in the name of another person or a contract for use is concluded by falsely stating the details of the purchase and reservation application information
The Site may restrict the purchase and reservation of service products for a period separately determined for customers whose purchase and reservation have been canceled under the above regulations.

Article 14 (Refund)
Customers can get a refund when the service product is refundable. Refunds can be made through the refund button at the bottom right of each product information on the inquiry page.
① Data + Incoming Calls Only eSIM refundable time: Refunds are not available once the QR code has been sent via email after payment is completed.
② Data + Calls & SMS eSIM refundable time: After payment is completed, a refund is available one day before the scheduled pick-up date. Refund is not available on the day of the scheduled pick-up or after the pick-up is completed. If you do not pick up on the day of the pick-up, the purchase will be automatically canceled and you will not be able to get a refund.
③ In addition, in the case of non-use of products without customer’s fault, such as system errors on the site or errors on the carrier, you can check it through the customer center and email and apply for refund.

Chapter 6 Compensation for Damages

Article 15 (Jurisdictional Court)

In the event of a dispute between the site and its members regarding the service, the court having jurisdiction over the location of the site’s headquarters shall be the competent court.
